Usage Policy
This Usage Policy (the "AUP") describes activities that are prohibited when using Hummingbird API (the "Service"). It is part of the Terms of Service. In addition to this policy, you must comply with the usage policies of the model providers accessed through the Service (such as OpenAI, Anthropic, and Google) — whichever is stricter applies.
1. Prohibited Uses
You may not use the Service to engage in, promote, or facilitate any of the following:
- Illegal activity: anything that violates applicable laws or regulations.
- Child safety: generating, obtaining, or distributing child sexual abuse material (CSAM), or any content that harms minors.
- Violence and weapons: planning or advancing violence or terrorism, or developing weapons, including chemical, biological, radiological, nuclear, and high-yield explosives (CBRNE).
- Critical infrastructure: operating or disrupting power, water, transportation, or financial infrastructure without proper authorization and human oversight.
- Cyberattacks and malware: generating malicious code, or carrying out intrusion, phishing, security-control evasion, or unauthorized access to systems.
- Privacy and surveillance: unlawfully collecting, inferring, or disclosing personal information, or conducting unauthorized surveillance, facial recognition, or profiling.
- Fraud and spam: scams, deceptive practices, plagiarism, academic dishonesty, or bulk unsolicited messaging.
- Misinformation and impersonation: deliberately creating misleading disinformation or deepfakes, or impersonating individuals or organizations without disclosure.
- Hate, harassment, and exploitation: content that is hateful, harassing, bullying, or sexually exploitative.
- IP infringement: infringing the copyrights, trademarks, or other rights of others.
2. High-Risk Use Cases and Human Oversight
When using the Service in areas that may significantly affect people's rights — such as healthcare, legal, financial, employment, or education — you must maintain meaningful human oversight (human-in-the-loop), must not rely on automated Outputs as the sole basis for decisions, and should, where appropriate, disclose to end users that they are interacting with AI.
3. Compliance and Enforcement
You are responsible for ensuring your use is lawful and for all activity under your account. We may investigate suspected violations and take action including rate-limiting, suspension, or termination, and will cooperate with law enforcement where legally required.
